Funeral Recording Terms for Viewlogies, LLC

Viewlogies values the funeral recording as a keepsake for you and for future generations. It is important for many to re-see and re-listen to the stories shared during a funeral service.

YOUR ACCEPTANCE

You affirm and certify that you are a surviving family member or have permission of the surviving family members to retain a recording of the funeral private broadcast. You understand that any misrepresentation, falsification, or omission of any facts called for in the Funeral Recording Download Form may be cause for legal action, whenever discovered.

COPYRIGHT & PRIVACY OF FUNERAL RECORDING

You acknowledge that the recording of the private broadcast may capture copyrighted materials, trademarks, intellectual property, and the faces and likeness of persons attending the funeral services as a result to their being broadcasted and recorded as part of the private broadcast of the funeral service. You accept that all streams and downloads are for personal use only and are password protected. Once you receive the link to the stream or recorded video file, you assume responsibility for distribution of that content and you hereby waive, release, and discharge forever, Viewlogies, their respective officers, directors, employees, and agents, from any and all liabilities, claims, demands, or causes of action whatsoever for any use or distribution of attendees’ faces, attendees’ private words, attendees’ personal audio, copyrighted material, derivative works, compilations, trade marks, trade secrets, or other intellectual property, music, video, or other content used in the videos of Viewlogies.

EXTERNAL INTERNET TECHNOLOGY

You understand that downloading the funeral recording utilizes specific outbound internet technology and internet communication services that are not under the control of Viewlogies and further understand that its availability and quality of content is dependent as well on internet technology and internet communication services of users. Viewlogies cannot, and does not, guarantee the availability or quality of the recorded funeral video, and it should not be relied upon in lieu of personally attending the funeral services.

GENERAL INTERNET USE

You acknowledge that events and activities related to, associated with, or connected with internet use, including, but not limited to viewing the video stream is entirely voluntary and can involve potential risks to the viewer’s computer, laptop, notebook, smartphones and other devices used that can cause the download of the funeral recording to not function as intended and/or may result in loss, damage, interruptions, errors, viruses, and delays.

VOLUNTARY ACCEPTANCE & INDEMNIFICATION

You represent and acknowledge that you are voluntarily accepting this agreement and all the terms. You agree to defend, indemnify, protect and hold harmless Viewlogies and each of its subsidiaries, shareholders, directors, officers, agents, employees and consultants against any and all damages, losses, liabilities, costs or expenses whatsoever (including attorneys’ fees and costs) and claims, actions, proceedings and/or lawsuits, whether direct or indirect, known or unknown, or foreseen or unforeseen, arising from or in any way connected with the distribution of private broadcast recordings provided by Viewlogies.

ABOUT THIS AGREEMENT

Modifying this Agreement

We may modify this Agreement, for example, to reflect changes to our process for the funeral recording or for legal, regulatory, or security reasons. If we have obtained your email information, Viewlogies will provide reasonable advance notice via email of any material modifications to this Agreement and the opportunity to review them, except that modifications addressing newly available features of the Service or modifications made for legal reasons may be effective immediately without notice. Modifications to this Agreement will only apply going forward. If you do not agree to the modified terms, you should delete all copies of the funeral recording and remove it from all locations that you have distributed it to.

Severance

If it turns out that a particular term of this Agreement is not enforceable for any reason, this will not affect any other terms.

No Waiver

If you fail to comply with this Agreement and we do not take immediate action, this does not mean that we are giving up any rights that we may have (such as the right to take action in the future).

Governing Law

All claims arising out of or relating to these terms or the Service shall be interpreted and enforced according to the laws of the State of Delaware. Should a dispute arise over any issue in this agreement resulting in the filing of a claim or lawsuit, venue shall be in Alameda County, California, USA. You and Viewlogies consent to personal jurisdiction in those courts.
